These Terms and Conditions shall apply to your use of this website and all purchases made. They do not affect your statutory rights. Any purchase made through this website shall be deemed conclusive proof of your acceptance of these Terms and Conditions. Any variations to these Terms and Conditions shall be inapplicable unless agreed in writing by us – Atlas Ceramics (South) Limited.

We may also revise or update these terms and conditions at any time without notice. Use of this site and purchases of products offered for sale on this site are subject to the terms and conditions posted on the site at the time of your visit.

Ordering

After selecting your products from the range available, you will proceed to the checkout area. You will be passed to a secure online payment authorisation service that will process your card details and obtain payment from your card provider.

We will send you written confirmation of your order by email but this email will not constitute acceptance of your order. We accept your order at the time we dispatch the ordered products to you and it is at that moment that a Contract for Sale is made between you and us. All our contracts are concluded in English although contracts for Sale will neither be filed by us nor accessible to you.

Your order will be based upon our product prices and delivery charges in force at the time you submit your order. If the prices or charges are different from those published this will brought to your attention before we accept your order and will give you the option to cancel your order before we accept it.

The seller shall accept no responsibility for late delivery provided that this is the result of circumstances beyond the seller’s control for example delays on the part of the seller’s own suppliers.

Please note acceptance of any order is at our discretion.

Ordering Samples

You can purchase many of our tiles online as a sample to give you an opportunity to see the quality of the bulk before you buy. In cases of larger or specialist tiles such as quarry round edges; a cut piece will be sent so as not to constitute a sale by sample. You shall take goods at their own risk as to their corresponding to the sample and as to their quality, condition or sufficiency for any purpose. You may order three samples per single transaction, however please note that in some cases such as mosaics; if 3 samples of the same are requested, only 1 will be sent, but we will try to accommodate all orders. Shading is an inherent part of Tiles. Therefore the sample you receive might differ slightly from your final order. With natural stone, this will differ more (in the case of natural stone Goods, these are sold on the express understanding that they are of natural stone which is subject to natural formation characteristics, variation in colour, texture, markings and moisture content). Sample sizes will be about 10 x 10 cm.

Prices and Delivery Charges

The prices payable for the items we offer for sale are clearly displayed on this site in pounds sterling and are inclusive of any excise duties and VAT payable unless otherwise stated. These prices are subject to alteration without notice.

Prices do not include the costs of delivery, details of which are set out below. Delivery charges are non-refundable unless returning damaged or faulty products.

You must make all arrangements necessary to take delivery of products when we deliver them in accordance with the stated delivery times for the delivery charge you have paid. If you do not accept delivery of the products or we are unable to deliver or are delayed in delivering products because of your actions or omissions then we may charge you and you will be liable to pay us for all costs we incur.

Please note: All delivery charges are for orders made online only and don’t apply to those orders made in store. Delivery charges for store orders will differ according to the quantity ordered and your area. Charges for delivery will not be shown with a breakdown of VAT on your invoice, if you are VAT registered and require this in addition to the standard confirmation invoice, please contact us.

As a standard part of our service, we aim to deliver between 3-7 working days. Orders placed after 1.00 pm will be processed on the following working day. You will be informed of when we anticipate your delivery between 24-48 hours. Sample tiles will arrive on a separate delivery within 2-4 working days if there are additional items ordered in the same transaction.

Important Notice: Orders are delivered by various carriers, due to insurance and health and safety regulations we are unable to transport any goods into a property. Many of our deliveries will arrive on a pallet and will be delivered to the nearest accessible hard standing location, this may be the kerbside. Risk in respect of the Goods passes to you, from the moment of delivery, orders should be checked at the moment of delivery and the driver notified of any breakages at the time of delivery. Photographic evidence at the point of delivery is required to prove a claim for breakages. It is usual to expect a small percentage of breakages during delivery and these are normally used as cuts by the tiler or customer.

Payment

We accept the following cards:

We will take payment from your card at the time you submit your order.

We also accept Paypal as a payment method.

Checks and Planning Ahead

We always recommend that you consult with your tiler once your items have been delivered and checked. This will enable you to resolve any technical questions or to order specific additional fittings if necessary. We cannot under any circumstances accept any financial demands for any third party costs incurred due to planning ahead.

It is preferable to purchase tiles, borders and decors from the same range as our tiles may be sourced from different suppliers which may result in a slight variation in size/colour. If in doubt please contact us for advice.

Please check your tiles carefully before fixing. Shade variation is a design feature and is inherent in the manufacture of most tiles and once the tiles are fixed it will have been deemed that the tiler has checked the tiles for any faults, quality or shading issues prior to fixing and has accepted their condition and at the time of fixing the tiles become the responsibility and liability of the tiler. To minimise shade variation it is common to choose from assorted boxes at the time of fixing.

No tiles are guaranteed against crazing or shade variation. If for any reason you are not happy with the shade or your choice of tiles, we cannot accept any responsibility after the tiles have been fixed and we cannot accept any liability for further or sub sequential loss or expense if the tiles are faulty, or not to your acceptance. Any such issues will be passed to the manufacturers, whereby any claims will become solely the manufacturer’s liability. Disclaimers or notes printed on boxes or packaging is your duty to read and accept prior to fixing.

We cannot accept any liability in respect of any defect arising from fair wear and tear, wilful damage, negligence, abnormal working conditions, failure to follow our instructions if requested (whether oral or in writing), misuse or alteration or repair of the Goods without our approval.

Cancellations

You are welcome to cancel your order prior to its dispatch (however if a special order item has been dispatched from our supplier to us we cannot cancel the order). However, if you cancel your order after its dispatch, in the case of Stock Items only, the product must be unused and returned in the original packaging in a re-saleable condition within 30 days of receipt of your goods. This applies to full boxes only. In this case, you will receive a refund of the price paid for the Goods minus £50 or 30% handling charge of the net value of the items returned, whichever is greater (excluding delivery and collection charges) subject to VAT. Admin charges may also be applied.

Special order/non-stock tiles, hand-painted tiles, glass tiles, borders, mosaics, listellos, inset tiles and all sale items are non-returnable once dispatched.

Returns

In addition to your right to cancel your order, we accept returns in accordance with our returns policy set out below.

Returning Samples

Sample tiles are non-returnable.

Damaged Samples

Every effort will be made to ensure your samples will arrive in perfect condition. If your sample tiles arrive damaged, please call or email us for replacements.

Exchanges and Returns Policy

Where the products are faulty or damaged on arrival you can exchange or return these items in the following ways:-

Direct Exchange via Courier
If you are exchanging a faulty or damaged item, please call or send us an email within 24 hours of delivery, stating the exact conditions for which you wish to make your exchange, such as shortage or damage to items during transit. We will endeavour to deliver the replacement Goods usually within 48 hours. It may not be possible in some cases for our courier to collect the faulty/damaged Goods and deliver the replacements at the same time.

Direct Return via Courier
If you are returning a faulty or damaged item, please call or send us an email within 24 hours of delivery, stating the exact conditions for which you wish to make your return, such as shortage or damage to items during transit. The courier will collect the Goods from the delivery address usually within 48 hours and between the hours of 9 and 5. You will receive a full/partial refund including the delivery and collection charges* once the Goods have been fully inspected. Refunds are paid within 30 days of receipt of the returned order.

*The delivery and collection charges are refunded for damaged or faulty goods, however if more than one item was ordered and a claim is being made for part of the order for being faulty or damaged, the delivery charge is non-refundable.

Where you change your mind about the particular product and wish to return the Goods the following will apply:

If the product returned is not in fully re-saleable condition or the packaging is damaged, we reserve the right to refuse a refund on the item. This does not affect your statutory rights.

Important Notice: Any claims which are based on any defect in the quality or condition of the Goods or their failure to correspond with specification shall (whether or not delivery is refused by you) be notified in writing to us within 24 hours from the date of delivery. If delivery is not refused, and you do not notify us accordingly, you shall not be entitled to reject the Goods and we shall have no liability for such defect or failure, and you shall be bound to pay the price as if the Goods had been delivered in accordance with the Contract.

Where any valid claim in respect of any of the Goods which is based on any defect in the quality or Condition of the Goods or their failure to meet specification is notified to us in accordance with these Conditions, we shall be entitled to replace the Goods (or the part in question) free of charge or, at our sole discretion, make a refund to you, the price of the Goods (or a proportionate part of the price), but we shall have no further liability to you.

Description of Goods

All images, descriptive matter, specifications designs and advertising on our website (including copyright, design right, or other intellectual property therein) shall be the exclusive right of the manufacturer and are for the sole purpose of giving an approximate description of the Goods. Please note that although every effort has been taken to ensure that the tiles are accurately depicted, colours may vary according to your individual monitor, browser, and graphics card settings. Any description of Goods appearing on our promotional material is believed to be correct and current but is not warranted by us and in so far as any such publication has been compiled from information supplied to us by our manufacturers and suppliers we accept no responsibility for the accuracy of any such description. All specifications given to the Customer are approximate and intended as a guide only. We always endeavour to ensure all product descriptions are correct but advise customers to seek technical advice from qualified sources prior to ordering products and any work to be carried out. In the case of natural stone Goods, these are sold on the express understanding that they are of natural stone which is subject to natural formation characteristics, variation in colour, texture, markings and moisture content.

Ownership of rights

All rights, including copyright, in this website are owned by or licensed to us. Any use of this website or its contents, including copying or storing it or them in whole or part, other than for your own personal, non-commercial use is prohibited without our permission. You may not modify, distribute or re-post something on this website for any purpose.

Technical Information

If you require any technical information about any of our products please contact us, we have many information packs and leaflets that may be helpful prior to fixing.

Natural stone tiles and mosaics should be sealed before and after fixing. Ensure to seal prior to grouting.

Privacy Policy

We are committed to protecting your privacy and fulfilling its obligations under UK Data Protection Laws.

We will use your personal information in order to inform you of our offers, news and for profiling your purchasing preferences and other marketing purposes. We may disclose your information to our service providers and agents for these purposes. We may keep your information for a reasonable period to contact you about our services in the future.
The Data Protection Act puts obligations on users of personal information and details principles for its use and we adhere strictly to these guidelines.

Any material downloaded or otherwise obtained through the use of this web site is done at your own discretion and risk and that you will be solely responsible for any damage to your own computer system or loss of data that results from the download of any such material.

Governing law

These Terms and Conditions and each Contract for Sale are governed by English Law.

Recommended Installers

We do not offer an installation service ourselves. Instead, we may on occasion recommend local tilers that we believe, to the best of our knowledge, to be very capable. Please note that these tilers are not in our employ and we cannot be held responsible for their work. Any contract that you form for installation is between you and the installer and not Atlas Ceramics (South) Ltd.
